Domestic Reverse Charge for Overseas Construction Businesses

If your overseas business provides construction services in the UK, the UK VAT rules can be complex—especially the Domestic Reverse Charge (DRC). This special rule affects how VAT is accounted for in the UK construction sector and can have a major impact on your invoicing, cash flow and compliance.

We support international construction businesses in getting it right, from identifying if DRC applies to issuing compliant invoices and managing your VAT returns.

What Is the Domestic Reverse Charge (DRC)?

The Domestic Reverse Charge is a UK VAT rule introduced to prevent fraud in the construction sector. It applies to certain construction services where both the supplier and customer are VAT-registered and registered under the UK Construction Industry Scheme (CIS).

Under DRC:

  • The supplier does not charge VAT on the invoice.
  • The customer accounts for the VAT on their own VAT return.
  • This applies only to supplies between UK VAT-registered businesses.

When Does the DRC Apply?

DRC applies when:

You are supplying construction services that fall within the CIS (e.g. building, installation, demolition, repairs, decorating, etc.)

  • Your customer is VAT-registered in the UK and also registered as a contractor under CIS.
  • The services are not zero-rated (e.g. new residential buildings).
  • The customer is not an end user (i.e. they are not the final consumer of the services).

Even if your business is based overseas, DRC applies if you are VAT-registered in the UK and making supplies to another UK VAT-registered contractor.

What Does “End User” Mean?

An end user is typically the property owner or developer who is not selling on or subcontracting the construction services. If your customer is an end user, DRC does not apply and normal VAT rules apply. This often means you are required to charge UK VAT, but the international reverse charge may apply in certain circumstances.

You should ask your customer to confirm their end user status in writing, ideally as part of the contract.

Construction Services in Scope

DRC generally covers services included in the CIS, such as:

  • Construction, alteration or repair of buildings
  • Electrical or plumbing installation
  • Decorating, painting, tiling
  • Site preparation or demolition
  • Civil engineering works

If goods and materials are supplied as part of the same contract, DRC also applies to the goods, even though CIS normally applies to labour only.

If the invoice includes a mix of services, the entire invoice may fall under DRC.

What Must Be Shown on Invoices?

Even though you do not charge VAT, your invoice must:

  • Show that the Domestic Reverse Charge applies
  • Show the amount of VAT due or the VAT rate
  • Include standard UK VAT invoice details (e.g. VAT numbers, dates, descriptions)

Example wording:

  • “Reverse charge: Customer to pay the VAT to HMRC”
  • “VAT Act 1994 Section 55A applies”

How Does It Affect Your VAT Return?

If you are the supplier:

  • Do not include output VAT in Box 1 of your VAT return
  • Include the net sales value in Box 6 only

If you are the customer:

  • Include the output VAT in Box 1 (as if you charged yourself the VAT)
  • If reclaimable, include the same VAT as input VAT in Box 4
  • Include the net purchase in Box 7

Common Pitfalls for Overseas Suppliers

Charging VAT in error

If you apply VAT when DRC applies, the customer cannot reclaim it

Incorrect invoicing

Invoices missing the DRC wording will be rejected

Assuming the customer is an end user

Always ask for confirmation

No UK VAT registration

DRC only applies if both supplier and customer are VAT-registered in the UK

Paying supplier invoices with overseas VAT

In some cases, your overseas-based suppliers may incorrectly apply foreign VAT on their invoices. Your purchase ledger team must identify and reject any invoice that does not apply the correct VAT treatment under UK rules before processing payment. HMRC may not allow recovery of VAT incorrectly invoiced.
