Workplace Pensions & Auto-Enrolment

Guidance for Overseas Employers with UK Staff

If you are responsible for HR or personnel matters at group headquarters and have a UK workforce – whether employed through a UK subsidiary or directly by an overseas company – you will need to comply with the UK’s workplace pension legislation. Under the UK’s automatic enrolment rules, all employers must offer a compliant pension scheme to eligible workers. This page explains what you need to do, common questions we help with, and how we support our international clients with workplace pension compliance.

What is Auto-Enrolment?

Automatic enrolment (often called ‘auto-enrolment’) is a legal requirement in the UK. It means employers must:

  • Set-up a compliant workplace pension scheme.
  • Automatically enrol all eligible employees.
  • Make minimum pension contributions.

Re-enrol employees every three years. These obligations apply regardless of whether your business has just one employee in the UK or many.

Who Must Be Auto-Enrolled?

You must enrol any UK-based worker who:

  • Is aged between 22 and the UK State Pension Age,
  • Earns at least GBP 10,000 per year,
  • Ordinarily works in the UK.

Employees have the right to opt out – but only they can make that decision. You cannot opt out on their behalf, and they must be re-enrolled every three years.

Workplace Pension Options

You can choose from several workplace pension providers. A popular option is NEST, the government-backed scheme open to all employers. However, there are many others.

Please note: Choosing a pension provider is a regulated activity in the UK. We cannot advise on which pension scheme to use, but once you have chosen one, we can assist with set-up and ongoing compliance.

Minimum Contributions

The legal minimum contributions (as a percentage of qualifying earnings) are:

  • Employer: 3%
  • Employee: 5% (can be partly made up of tax relief from HMRC)
  • Total: 8%

Qualifying earnings are monthly gross pay over GBP 520 and capped at GBP 4,189 (2024/25 tax year).

Employers can contribute more than the minimum or apply the contributions to total earnings instead of just qualifying earnings – we can help with the calculations.

Standard vs Salary Exchange Contributions

You can choose how pension contributions are made:

Standard Method (Relief at Source)

  • Contributions are deducted after tax and NIC.
  • Tax relief is partially claimed by the pension scheme.
  • i.e. 5% Employee Contribution would be (4% deducted from Employee and 1% tax relief would be automatically claimed by the pension fund from the UK Government)

Salary Exchange (Salary Sacrifice)

  • Employee agrees to a lower salary.
  • Employer contributes the “sacrificed” amount to the pension.
  • Saves both parties National Insurance

We recommend seeking financial advice before setting up a salary exchange scheme. We can help model the cost impact and run calculations.

Paying into a Private Pension Scheme?

Employees may ask you to pay contributions into their private pension instead. Yes, this is possible – but it must be managed carefully:

  • You still have to set-up a workplace pension scheme.
  • You must auto-enrol eligible staff.
  • You can only pay into the private scheme after the employee has opted out of the workplace scheme.
  • You’ll need a policy decision on whether you’re prepared to do this for future staff.

We help you navigate these commercial and compliance considerations.
